Terms & Conditions
The Essence of T&C
These Terms & Conditions (“Terms”) govern all bookings, services, and purchases from Mixology Art LLC (“Mixology Art,” “we,” “us,” “our”). By paying a retainer, signing a proposal, purchasing a product, or booking a call/class, you (“Client,” “you,” “your”) agree to these Terms.
Key Components of T&C
- 
Private Events (Dry Hire): Bartending labor, expertise, and bar tools. Alcohol is client-provided unless otherwise stated.
 - 
Consulting: Menu strategy, recipe R&D, tastings, SOPs, cost/oz modeling, creative assets, and rollout support per proposal.
 - 
Classes: Ticketed or private instruction sessions.
 - 
Deliverables: Any documents, menus, photos, videos, graphics, or templates we provide.
 
Quotes, Pricing & Proposals
- 
Private Events (Dry Hire): Bartending labor, expertise, and bar tools. Alcohol is client-provided unless otherwise stated.

Booking, Retainer & Payment
- 
Retainer to secure date: 40% (events) or 50% (consulting). Non-refundable.
 - 
Balance due: Events 72 hours before service; consulting per proposal (e.g., 50/50 or 50/30/20).
 - 
Classes: Tickets are paid in full upon signing proposal.
 - 
Late payments: 3%/month or the legal maximum, whichever is lower. Chargeback fees are Client’s responsibility.
 
Cancellations & Reescheduling
- 
Client cancellation (events):
 - 
>30 days before: retainer becomes credit for 12 months.
 - 
8–30 days: pay 50% of latest estimate (retainer applied).
 - 
≤7 days: pay 100% of latest estimate (labor committed).
 - 
Consulting cancellation: Pay for work completed to date + 20% of remaining scope.
 - 
Reschedules are subject to availability and one free date move within 12 months.
 
Clients Responsibilities (Events & Classes)
- 
Unless purchased from us, Client provides alcohol, glassware, ice, mixers, water, power, and an appropriately sized, safe workspace.
 - 
Client obtains required permits/permissions and ensures venue access for setup/breakdown.
 - 
Client provides trash receptacles and allows reasonable load-in/out time.
 
Alcohol Compliance & Service Refusal
We follow NC law: service to 21+ only with valid ID; we refuse service to intoxicated or disorderly persons at our discretion. Client agrees not to encourage over service and to monitor guest conduct. Client indemnifies Mixology Art for fines/claims arising from Client’s violation of alcohol laws.
Health, Allergies & Safety
Some products may contain potential allergens (e.g., nuts, dairy, honey, gluten). Client must notify us of allergies in writing at least 7 days prior; we take reasonable precautions but cannot guarantee an allergen-free environment. We operate with standard hygiene practices; sanitation and hand-washing access must be provided.
Force Majeure
Events outside either party’s reasonable control (e.g., severe weather, utility outages, illness, government restrictions) excuse performance for the affected period. We’ll work in good faith to reschedule; fees already incurred (planning, rentals, third-party) remain payable.
Media, Content & IP
- 
Event/Class Media: Unless you opt out in writing before the event, you grant Mixology Art the right to capture and use photo/video/audio of the bar setup and beverages for portfolio, web, and social media (no private/guest-sensitive content will be used upon request).
 - 
Consulting Deliverables: You receive a non-exclusive license to use recipes, SOPs, menus, photos, and copy at your venue/brand. You may not resell, share publicly as templates, or license to third parties without written consent. We retain all IP ownership.
 - 
Content Licensing: Photos/reels delivered include web/social use; print, OOH, or paid ads beyond 12 months require credit or a negotiated license.
 
Power Guarantee (Consulting)
Our Art-In-Profit™ Power Guarantee applies to consulting packages with the following summary (full policy on the Guarantee page):
- 
At kickoff, Client selects 2 KPIs (e.g., pour cost target, sales/attachment, build time, content performance).
 - 
Within 30 days of go-live, if any two selected KPIs are missed and Client followed pricing/placement, SOPs, staffing, and posting cadence, Client may choose:
 - 
Cash-back: up to 30% depending on tier + 30 days of optimization free, or
 - 
Free upgrade of deliverables from the next tier.
 - 
Client must provide POS and social insights to measure results. Exclusions: closures, stockouts, force majeure. (See full guarantee for details.)
 
Warranties & Liability
- 
Services are provided “as is” with industry-standard care. We do not warrant specific profit outcomes beyond the guarantee above.
 - 
Limitation of liability: To the maximum extent permitted by law, our total liability is capped at the amount you paid to Mixology Art in the 30 days preceding the claim; we are not liable for indirect, incidental, or consequential damages.
 
Indemnification & Privacy
Client agrees to hold harmless and indemnify Mixology Art, its owners, and staff from claims, damages, or expenses arising out of Client’s negligence, violation of laws, or breach of these Terms. We collect only the information necessary to deliver services and communicate offers. We do not sell personal data. See our Privacy Policy for details and opt-out instructions.
E-Commerce (Syrups & Goods)
- 
Shipping/handling: Calculated at checkout.
 - 
Returns: Unopened, resaleable goods within 14 days of delivery (Client pays return shipping). Perishables/opened items are non-returnable.
 - 
Use & Storage: Follow label instructions. Not intended for persons with related allergies; use at your own discretion.
 
Dispute Resolution & Governing Law
These Terms are governed by the laws of North Carolina. Venue for disputes is Buncombe County, NC. Parties will first attempt good-faith negotiation, then mediation, before litigation.
Acceptance: Paying a retainer, signing a proposal, booking a class, or purchasing products constitutes acceptance of these Terms.
